James Butler has filed a lawsuit against two marine companies, alleging negligence after suffering injuries at their facility. The complaint was filed in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, on January 3, 2025, naming Giuffre South, Inc., doing business as Seminole Marine Maintenance and Seminole Marine, LLC as defendants.
The case revolves around an incident that occurred on March 22, 2024, when Butler was visiting the marina operated by the defendants. According to the complaint, Butler tripped and fell on construction debris and uneven terrain while walking through a common area of the premises. This fall resulted in serious injuries for which Butler is seeking compensation. He accuses both companies of failing to maintain a safe environment for patrons like himself who frequent the marina to perform maintenance and repairs on their boats.
Butler's lawsuit highlights several key points of alleged negligence by both Giuffre South, Inc., and Seminole Marine, LLC. He claims that these entities had a non-delegable duty to ensure their premises were safe for visitors. Specifically, he accuses them of failing to maintain the marina in a reasonably safe condition and allowing hazardous conditions to persist without adequate warning or remediation. "The dangerous conditions/behavior that caused Butler’s injury existed at the Marina long enough that the Defendant knew or under the exercise of reasonable care should have known," states one part of the complaint.
In addition to maintaining safety standards, Butler asserts that both companies failed in their duty to inspect and monitor their property for potential hazards. The complaint suggests that had they exercised reasonable care in inspecting and correcting unsafe conditions promptly, his injuries could have been avoided.
Butler is seeking damages exceeding $50,001 from each defendant along with costs and prejudgment interest. He demands a trial by jury to determine fair compensation for his pain and suffering, medical expenses incurred due to his injuries, loss of enjoyment of life, and any ongoing or future losses resulting from this incident.
