A job interview turned into a legal battle as a Florida resident claims negligence led to his permanent injury. On December 27, 2024, Timothy Palladino filed a complaint in the Circuit Court of the 15th Judicial Circuit in Palm Beach County against Acorn Mini Storage of Boca, LLC, Acorn Ministorage, Inc., and Acorn Management & Development Co.
The case revolves around an incident that occurred on December 26, 2023, when Palladino attended a job interview at the premises of the defendants located at 5555 N. Dixie Hwy., Boca Raton, FL. During the interview, Palladino was instructed by Mr. James, a store manager also serving as district manager for the defendants, to demonstrate his ability to lift 60 pounds by lifting the front of a trailer. Unbeknownst to Palladino, the trailer was parked too closely to another trailer, making it impossible for it to tilt properly when lifted from the front. This resulted in an unexpected jerking motion that caused severe and permanent injuries to Palladino.
Palladino accuses Acorn Mini Storage of Boca and its associated companies of negligence for failing to maintain safe conditions on their premises. The complaint alleges that the defendants knew or should have known about the hazardous parking arrangement but failed to address it before instructing Palladino to lift the trailer. "Defendants OWNER, COMPANY, and MANAGEMENT caused, knew, constructively knew, or should have known that the Subject Trailer was parked too closely," states Palladino's complaint.
The plaintiff is seeking damages exceeding $50,000 exclusive of interest and attorney fees. He claims multiple damages including bodily injury resulting in pain and suffering, disability expenses for ongoing medical care, disfigurement, mental anguish, inconvenience and loss of capacity for enjoyment of life—all elements recognized under Florida law as grounds for compensation due to negligence.
