Dominguez's legal filing accuses each defendant of negligence for not implementing adequate safety policies or procedures to identify and correct dangerous conditions such as the unstable ramp. She claims they neglected their duty of care by failing to install handrails or warning signs around the hazard. The lawsuit states that these oversights created "a foreseeable zone of risk" for visitors like herself.

In her complaint, Dominguez describes how the dangerous condition led her to twist her foot on the ramp's uneven surface, resulting in permanent bodily harm.
