A couple in Palm Beach County has taken legal action against a major retail corporation following an incident that allegedly left one of them injured. On December 23, 2024, Marisol Cruz-Sokol and John Sokol filed a complaint in the Circuit Court of the Fifteenth Judicial Circuit in Palm Beach County, Florida, against Target Corporation and its employee, Liam Alejandro Flores Silva.
The lawsuit stems from an incident on December 2, 2023, when Marisol Cruz-Sokol visited a Target store located at 10201 Hagen Ranch Road in Boynton Beach. While shopping in the seasonal section of the store, she reportedly slipped on a sanitizing wipe that was left on the floor. The complaint claims that this wipe constituted an "unreasonably dangerous and/or hazardous condition." According to the plaintiffs' allegations, Target Corporation failed to maintain safe premises for its customers and neglected its duty to warn about potential hazards. They argue that Target had actual or constructive knowledge of the dangerous condition but did not take appropriate measures to address it.
Marisol Cruz-Sokol's negligence claim against Target asserts that the company breached its duty of care by failing to inspect and maintain the premises safely. She accuses Target of several lapses, including inadequate staffing for proper maintenance and failure to correct or remove hazardous conditions. As a result of these alleged failures, Marisol claims she suffered bodily injuries leading to pain, suffering, disability, disfigurement, mental anguish, loss of income, and medical expenses.
Additionally, Marisol has filed a separate negligence claim against Liam Alejandro Flores Silva. As an employee present at the time of her fall, he is accused of failing to ensure the safety of the premises by neglecting his duties to inspect and maintain them properly. The lawsuit alleges that Flores Silva had better knowledge than Marisol regarding potential hazards but did not provide necessary warnings.
John Sokol has also filed claims for loss of consortium against both defendants due to his wife's injuries. He argues that their negligence deprived him of her companionship and support.
The Sokols are seeking compensatory damages exceeding $50,000 from each defendant along with interest on liquidated damages and attorneys’ fees under applicable statutes or rules. They have requested a jury trial for all triable issues as part of their pursuit for justice.
