A former employee has filed a lawsuit against his previous employer, alleging discrimination and wrongful termination. Luis Alexander submitted the complaint on December 19, 2024, in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, targeting MDG Advertising, now known as Jamdel, Inc., and Anthony Del Gigante.
The case centers around allegations that Alexander faced discrimination during his tenure at MDG Advertising. He claims that Anthony Del Gigante, who was his supervisor and also the son of the company's owner, made unwanted sexual advances towards him. When Alexander rejected these advances, he alleges that he was retaliated against by being terminated from his position. Furthermore, Alexander accuses the company of discriminating against him based on his LGBT status, disability, and Hispanic national origin. According to the complaint, MDG failed to engage in an interactive process or accommodate his disability and treated other employees outside of his protected class more favorably. On March 17, 2024, Alexander filed a charge with the Equal Employment Opportunity Commission (EEOC), citing discrimination and retaliation under the Florida Civil Rights Act.
In seeking justice for what he perceives as wrongful conduct by MDG Advertising and its representatives, Alexander is pursuing both compensatory and punitive damages. He argues that the defendants' actions were intentional and carried out with a conscious disregard for his rights. The lawsuit specifically invokes Florida Statute §760.10 related to unlawful employment practices due to sex (LGBT), national origin, and disability discrimination. Additionally, it includes a claim for tortious interference with business relationships against Del Gigante personally.
Alexander's legal team from Behren Law Firm is pushing for a jury trial to address these grievances. They are demanding compensatory damages for mental anguish and loss of dignity alongside punitive damages as allowed under Fla. Stat. § 760.11. The relief sought also includes interest on any awarded amounts as well as court costs and attorneys’ fees.
