Michael Collins has filed a lawsuit against Florida Kidney Physicians, LLC, and Dr. Carlos Duran-Martinez, alleging medical negligence that led to severe health consequences. According to the complaint, Michael Collins was under the care of Florida Kidney Physicians and Dr. Carlos Duran-Martinez as of October 7, 2020. On this date, both a sonogram ultrasound and a CT scan were conducted, revealing a mass in Collins' right kidney that suggested renal cell carcinoma. However, the CT scan report failed to mention this critical finding. Despite receiving conflicting reports regarding the presence of a mass in Collins' kidney, Dr. Duran did not follow up with the radiologist to confirm its existence.
The plaintiff alleges that due to Dr. Duran's failure to act on these findings, the mass went untreated and grew over time. This negligence ultimately resulted in Collins undergoing a full nephrectomy—a surgical procedure involving the removal of his kidney—leaving him with significantly reduced kidney function.
Collins claims that he has suffered from various physical and emotional damages due to this oversight. These include bodily injuries leading to pain and suffering, disability, disfigurement, mental anguish, loss of enjoyment of life, inconvenience, and significant medical expenses for treatment and hospitalization.
In seeking justice for these grievances, Collins is asking for general and special damages from both defendants—Florida Kidney Physicians and Dr. Carlos Duran-Martinez—in amounts to be determined at trial. He also seeks compensation for costs incurred due to their alleged negligence.
