A homeowners association has filed a lawsuit against a prominent developer and two other companies, alleging construction defects in a residential community. The Walk at Indian Rocks Beach Homeowners Association, Inc. filed the complaint on December 12, 2024, in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida, targeting Taylor Morrison of Florida, Inc., Vortex Engineering, LLC., and Davis-Bews Design Group, Inc.
The case centers around alleged construction defects and deficiencies affecting the community's infrastructure and homes. The Walk at Indian Rocks Beach is a residential development comprising thirty-two townhomes with various common areas such as a swimming pool and roads. According to the complaint, Taylor Morrison served as both the developer and general contractor for the project. The association claims that Taylor Morrison failed to adhere to sound building practices and violated the Florida Building Code during construction.
The association accuses Taylor Morrison of negligence for not constructing the community’s improvements in accordance with applicable codes and standards. It also alleges that Taylor Morrison breached warranties by delivering homes with defects despite assurances of quality workmanship. Additionally, the complaint includes counts of vicarious liability and negligent selection against Taylor Morrison for hiring subcontractors who allegedly performed substandard work.
Vortex Engineering is accused of professional negligence for failing to design the community's improvements properly. Similarly, Davis-Bews Design Group faces allegations of professional negligence for its role in designing parts of the development that reportedly do not meet required standards.
The plaintiffs are seeking damages exceeding $50,000 per cause of action to cover repair costs for identified defects such as stucco issues, roof leaks, drainage problems, and mold presence among others. They also seek compensation for incidental and consequential damages arising from these deficiencies.
