Estate Sues Nursing Home for Negligence Leading to Wrongful Death

A Florida estate has filed a lawsuit against a local healthcare facility, alleging negligence and wrongful death in the care of an elderly resident. The Estate of Julia Voronovich, represented by John Voronovich Jr., lodged the complaint against Lexington Healthcare and Rehabilitation Center, LLC, on December 5, 2024, in the Circuit Court of the Sixth Judicial Circuit in Pinellas County.

The case revolves around allegations that Lexington Healthcare failed to provide adequate care for Julia Voronovich during her stay at their facility from December 20, 2022, until January 31, 2023. Julia Voronovich was a vulnerable adult at the age of ninety-three when she was admitted to the nursing home. According to the complaint, during her residency, she suffered neglect and abuse resulting in pressure injuries to her coccyx and left heel, which contributed to unnecessary pain and suffering. The plaintiff claims that these injuries were a direct result of Lexington Healthcare's failure to meet its statutory obligations under Florida Statute §400.022.

The lawsuit accuses Lexington Healthcare of several breaches of duty including failing to provide appropriate attention to Voronovich’s risk for pressure wounds and not ensuring sufficient staffing levels with adequately trained personnel. "Defendant's breach of the above duties...was the legal cause of her loss, injury and damages," states the complaint. It further asserts that these failures led directly to Voronovich's suffering and eventual death on May 14, 2023.

The plaintiff is seeking damages exceeding $50,000 for both general and specific violations of residents' rights as well as costs associated with bringing this action. They are also demanding a jury trial to resolve these issues. The suit highlights not only negligence but also seeks accountability for wrongful death under Florida Statutes §400.023.
