Brook Brittain, who resided at Point Midtown Condominiums adjacent to the defendant's property, was walking her dog when she stepped into a concealed hole on a strip of grass owned and maintained by Family Church 2, LLC. This hidden hazard led to her falling and suffering multiple injuries. The complaint alleges that Family Church 2 failed in its duty to maintain safe premises and neglected to warn lawful visitors of potential dangers.

According to the lawsuit, Family Church 2 had control over the parking lot and surrounding areas at 4901 PGA Boulevard in Palm Beach Gardens. Despite this responsibility, they allegedly did not ensure proper maintenance or provide adequate warnings about the hazardous conditions present on their property. "As owner of the above-described area which is the subject of this litigation," states the complaint, "Defendant had a non-delegable duty to maintain the area in a safe and properly maintained manner."

Brittain accuses Family Church 2 of several specific failures: inadequate lighting, failure to warn about or rectify the dangerous hole camouflaged by grass, and not adhering to safety codes such as the Life Safety Code and Florida Building Code. The plaintiff argues these oversights amount to negligence that directly resulted in her injuries. As outlined in her filing through attorney Richard K. Slinkman from Slinkman, Slinkman & Wynne P.A., Brittain is seeking compensation for medical expenses related to hospitalization and spinal surgery among other damages like pain and suffering.

The plaintiff requests judgment for damages exceeding $50,000 along with costs and prejudgment interest as permitted by law. Additionally, she demands a trial by jury to resolve these claims against Family Church 2.
