Guadalupe Garcia Jimenez lodged the complaint in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida, on November 19, 2024, targeting Orlando Martinez and RDCR, LLC, operating as R&D Construction and Roofing.
The case centers around an incident on November 23, 2023, when Jimenez was injured while using a nail gun during a roofing project. The plaintiff claims that due to negligence and deliberate misconduct by the defendants—Orlando Martinez and R&D Construction—he suffered significant injuries. According to Jimenez's allegations, both defendants failed to provide necessary safety training and equipment, leading to the nail gun backfiring and causing him serious eye injury. "Defendants deliberately took actions that were virtually certain to cause serious injury," states the complaint.
Jimenez accuses the defendants of not only failing to secure workers' compensation coverage as required under Florida Statutes § 440 but also breaching their duty of care by neglecting essential safety protocols.
