Heather Schuster has filed a lawsuit against several entities for negligence following an incident at a music event that left her with significant injuries. The complaint was filed on October 31, 2024, in the Circuit Court of the Sixth Judicial Circuit in Pinellas County, Florida, naming Fairgrounds Projects, Inc., Factory Investors of St. Pete, LLC, and Divine Freak, LLC as defendants.

The case revolves around an accident that occurred on June 9, 2024, at a music event held at FloridaRAMA's premises in St. Petersburg. According to the complaint, Heather Schuster attended the event as an invitee when she tripped over what appeared to be a sculpture resembling sea oats or grass-like plants emerging from the ground. This unexpected obstacle caused her to fall and sustain serious injuries including damage to her left leg, foot, and thumb. Schuster alleges that all three defendants were negligent in maintaining a safe environment for attendees by failing to remove or warn about the hazardous sculpture.

Schuster claims that each defendant had either actual or constructive knowledge of the dangerous condition but did nothing to rectify it or alert attendees prior to the event. She asserts that Fairgrounds Projects and Factory Investors were responsible for managing and maintaining the premises while Divine Freak organized and promoted the music event. Schuster maintains she was not comparatively negligent and had no prior knowledge of the unsafe condition.

In her lawsuit, Schuster seeks damages exceeding $50,000 for medical expenses incurred due to her injuries, loss of income or earning capacity, as well as compensation for pain and suffering both mental and physical. She also demands interest on these amounts along with taxable costs and any other relief deemed appropriate by the court.
