A Palm Beach County resident has filed a lawsuit against two housing entities, alleging negligence after suffering severe injuries due to hazardous conditions at her apartment complex. On October 22, 2024, Catherine Cash filed the complaint in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, naming Boynton Bay, Ltd., doing business as Boynton Bay Apartments, and Florida Affordable Housing, Inc. as defendants.
According to the complaint, Catherine Cash claims that on October 26, 2021, she was residing at Boynton Bay Apartments when she slipped and fell on a stairway covered with mold and debris. The fall resulted in permanent and severe bodily injuries. Cash argues that both Boynton Bay Apartments and Florida Affordable Housing had a non-delegable duty to maintain the premises in a reasonably safe condition for residents like herself. She accuses them of multiple acts of negligence including failing to keep the stairs free from hazards such as mold and debris and not providing adequate warnings or safety measures like slip-resistant materials or caution signs.
The lawsuit details how these alleged failures created an unreasonably dangerous environment for residents. Cash contends that these conditions were known or should have been known by the defendants given their regularity and frequency. She further alleges that the defendants' policies and procedures were inadequate, leading to prolonged periods between inspections which allowed dangerous conditions to persist unnoticed.
Cash is seeking damages exceeding $50,000 for her injuries which include pain and suffering, disability, disfigurement, mental anguish, loss of enjoyment of life, medical expenses, and aggravation of pre-existing conditions. The complaint demands a jury trial to determine fair compensation for these losses.
