A Palm Beach County couple has filed a lawsuit seeking damages after a tragic incident left one of them severely injured. On September 11, 2024, Elline Melissa Walfish and her husband Harvey S. Walfish filed a complaint in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, against Wycliffe Charities Foundation, Inc., Wycliffe Community Realty, LLC, and Wycliffe Golf and Country Club Homeowners' Association, Inc.
The plaintiffs allege that on April 12, 2024, Elline Melissa Walfish was lawfully present at the premises located at or near 4650 Wycliffe Country Club Boulevard in Wellington, Florida when she was struck by a piece of wood affixed to a banner that fell from above. According to the complaint, this incident resulted in severe bodily injuries for Elline Melissa Walfish. The lawsuit accuses the defendants of negligence for failing to maintain safe conditions on their property and failing to warn guests about potential hazards.
"Defendant acted negligently and carelessly by creating a hazardous condition on the premises where members are intended to be," reads the complaint. The plaintiffs argue that the defendants had a non-delegable duty to inspect and maintain their premises safely but failed to do so. They claim that the defendants did not provide adequate warnings or take necessary precautions to prevent such accidents.
The plaintiffs are seeking compensatory damages exceeding $50,000 for medical expenses incurred due to Elline's injuries as well as for pain and suffering, permanent disability, disfigurement, loss of past wages, loss of future earning capacity, mental anguish, and loss of enjoyment of life. Additionally, Harvey S. Walfish is claiming damages for loss of services, comfort, society, and attention from his wife due to her injuries.
