A local resident has taken legal action against a prominent community association, alleging negligence that led to severe personal injuries. Rochelle Lieberman filed a complaint on July 26, 2024, in the Circuit Court of the 15th Judicial Circuit in Palm Beach County, Florida, against Indian Spring Master Association, Inc.

According to the complaint, Lieberman claims that on February 26, 2023, she was a guest at the property managed by Indian Spring Master Association located at El Clair Ranch Road and Westbourne Drive S in Boynton Beach. During her visit, she tripped and fell due to a defective and uneven sidewalk on the premises. The plaintiff asserts that this hazardous condition caused her significant injuries.

Lieberman’s lawsuit alleges that Indian Spring Master Association had either actual or constructive notice of the dangerous sidewalk but failed to address it adequately. "At all times material hereto," the complaint states, "the existence of the defective and uneven sidewalk created an unreasonably dangerous and unsafe condition." The plaintiff argues that the association breached its duty to maintain safe premises and failed to warn guests of latent dangers.

The specific accusations against Indian Spring Master Association include failing to maintain the property safely, not training or supervising employees properly to identify and repair hazards, not restricting access to dangerous areas, and not warning guests about existing dangers. As a result of these alleged failures, Lieberman sustained injuries leading to pain and suffering, disability, disfigurement, mental anguish, loss of enjoyment of life, medical expenses, lost earnings potential, and possibly aggravation of pre-existing conditions.

Lieberman is seeking damages exceeding $50,000 from Indian Spring Master Association for her injuries and losses. She also demands a jury trial for all triable issues.

The case is being handled by Joseph Stallone from Goldman & Daszkal P.A., while details regarding representation for Indian Spring Master Association have yet to be disclosed. The case ID is 502024CA007023XXXAMB Div: AE.
