Woman accuses Wendy's of violating Fair Labor Standards Act

A former employee says Wendy's didn't pay her proper overtime wages.

Viviana Soto Burgos filed her complaint in federal court against Wendy's, accusing the popular fast-food chain of violating the Fair Labor Standards Act by not paying her overtime wages and retaliating against her.

According to the complaint, Burgos worked as a general manager for Wendy's starting in 2007. She claims she performed the same tasks as those she supervised most of the time. She says she should have been paid an overtime hourly rate for hours worked over 40 in a workweek during her entire employment with Wendy's.

According to the complaint, Burgos was paid $26.88 as the regular rate and worked about 1560 overtime hours from December 15, 2019, to December 15, 2022. However, she claims she was not paid the required overtime premium under FLSA for these hours.

The plaintiff seeks compensatory damages.
