Rose Ricciardi sues Live Wire Electrical Services and Duke Energy Corporation for breach of contract and negligence

In the Circuit Court of the Sixth Judicial Circuit in and for Pinellas County, Florida, plaintiff Rose Ricciardi has filed a lawsuit against Live Wire Electrical Services, Inc., and Duke Energy Corporation. The case number is 24-001387-CI and was filed on March 27, 2024. The complaint alleges breach of contract and negligence leading to property damage.

Ricciardi, represented by an unnamed counsel, claims that she had a wiring repair protection plan with Duke Energy Corporation for her residence in Clearwater, Florida. On April 1, 2022, Live Wire Electrical Services was contracted to replace a hot water heater at her property. However, due to an alleged electrical issue and related damages caused by the defendants' actions or lack thereof, Ricciardi's property sustained significant damage.

The plaintiff asserts that despite paying all premiums due under the protection plan, Duke Energy Corporation failed to honor its obligations under the policy. This includes denying Ricciardi's requests for coverage and failing to issue payments necessary for repairs. As a result of this alleged breach of contract and negligence on part of both defendants, Ricciardi has suffered continued damages including property damage, incurred repairs costs, loss of use expenses among others.

Ricciardi is seeking a trial by jury and judgment against Duke Energy Corporation for damages including all contractual benefits, pre-judgment interest, costs and attorney’s fees pursuant to Florida Statute §627.428 and/or §626.9373 and/or §627.70152.
