In the County Court of the Sixth Judicial Circuit in and for Pinellas County, Florida, plaintiffs Bonnie Mccauslin and Shawn Mccauslin have filed a lawsuit against Heritage Property & Casualty Insurance Company. The case, bearing the number 24-002429-CO, was filed on March 20, 2024. The suit alleges breach of contract by the defendant and demands a jury trial.
The plaintiffs, represented by their undersigned counsel, claim that they had purchased property insurance from the defendant to cover their property located at 9450 Crestview Street, Seminole, Florida. The policy was in effect as of April 27, 2023. However, when their property suffered wind and/or hail damage on or about April 27, 2023, they allege that the defendant failed to fully indemnify them from loss.
According to the complaint, despite demand for payment, the defendant has failed or refused to fully indemnify the plaintiffs from the amount of loss. This refusal to reimburse adequately for damages constitutes a breach of contract. As a result of this alleged breach of contract by Heritage Property & Casualty Insurance Company, Bonnie and Shawn Mccauslin have incurred damages in the form of unpaid insurance proceeds along with interest costs and attorney’s fees.
The plaintiffs are seeking judgment against Heritage Property & Casualty Insurance Company for all damages with interest costs and attorney fees pursuant to Sections 627.70152 (July 1, 2021), 627.428 (July 1, 2021), 626.9373 (July 1, 2021), 57.041, and 57.104 of Florida Statutes.
