Sherona Barnes sues Wal-Mart Associates, Inc. and Shawn Wendell Mitchell for violation of privacy and employment laws

Sherona Barnes has filed a lawsuit against Wal-Mart Associates, Inc., and Shawn Wendell Mitchell in the Circuit Court of the Second Judicial Circuit, Leon County, Florida. The case number is 2023-CA- 2024 CA 000449 and was filed on March 18, 2024. The suit alleges violation of Chapter 760 and section 784.049(5) of Florida Statutes, known as Florida’s revenge-porn statute.

Barnes claims that she was victimized by unlawful employment practices due to her gender and retaliation after reporting these practices. She also accuses Mitchell of committing tortious acts against her within Leon County, Florida. The claim involves an amount exceeding $50,000 exclusive of costs and interest.

The plaintiff asserts that while employed by Wal-Mart, personal images shared with Mitchell were disseminated without her consent causing substantial emotional distress. It is alleged that these images were further shared by Wal-Mart employees including managers leading to her termination.

Barnes seeks judgment for the violation of privacy and employment laws under the statutes mentioned above. She argues that she satisfied all conditions precedent to bringing this action having dual-filed a charge of discrimination against Wal-Mart with the Florida Commission on Human Relations and Equal Employment Opportunity Commission.
