Pamelia Hawkins has filed a lawsuit against AAA Tree Experts, Inc., and Consesion Mendez in the Circuit Court of the Second Judicial Circuit in Leon County, Florida. The case, numbered 2024 CA 000442, was lodged on March 15, 2024. The complaint alleges negligence on the part of Mendez and vicarious liability of AAA Tree Experts, Inc., following a vehicular accident.
Hawkins asserts that on July 13, 2023, Mendez, while operating a vehicle owned by AAA Tree Experts, Inc., collided with her vehicle on Monroe Street in Tallahassee. She accuses Mendez of failing to maintain control of his vehicle and not yielding to oncoming traffic. The plaintiff is seeking damages exceeding $50,000 for bodily injury, pain and suffering, disability, disfigurement, mental anguish among other losses.
The suit also implicates AAA Tree Experts under the Dangerous Instrumentality Doctrine and Respondeat Superior principles. This is due to Mendez being an employee of the company at the time of the accident and using a company-owned vehicle.
Hawkins seeks judgment against both defendants for her damages. She also demands a trial by jury on all issues so triable.
