In the County Court in and for Pinellas County, Florida, plaintiff Kellie Marie McCarty has filed a lawsuit against Progressive American Insurance Company. The case, bearing the number 24-001959-CO, was filed on March 4, 2024.
The plaintiff alleges that she was seriously and permanently injured in an automobile collision caused by an underinsured motorist on August 31, 2022. McCarty claims that as a direct result of the accident she suffered injuries to her head, neck, body and limbs resulting in significant damages including loss of important bodily function, permanent injury within a reasonable degree of medical probability other than scarring or disfigurement; bodily injury; disability; pain and suffering; disfigurement; mental anguish; loss of capacity for the enjoyment of life; medical and related expenses in seeking a cure for her injuries; loss or diminution of earnings or earning capacity; aggravation of preexisting conditions or diseases.
The plaintiff is seeking a trial by jury and judgment against Progressive American Insurance Company for damages over $8,000 but less than $50,000 excluding costs, interest and attorney fees. The case is being represented by Matthew E. Noyes from Perenich Caulfield law firm.
