Woman accuses Disney Vacations of FMLA, ADA violations

A woman is accusing Disney Vacation Development of violations of the Family and Medical Leave Act and the Americans with Disabilities Act.

Johanna Padilla filed her federal lawsuit against Disney Vacation Development Inc.

Padilla claims she suffered from a serious health condition necessitating her to take FMLA leave. She says she was retaliated against and subjected to an increasingly hostile work environment as a result of her disability or perceived disability.

According to the complaint, Padilla says she experienced interference, retaliation and disability discrimination while employed by Disney Vacation Development. She is seeking recovery for back pay, liquidated damages, other monetary damages, reinstatement, injunctive relief, equitable relief, front pay, declaratory relief and attorney fees and costs.

Prior to filing this lawsuit, Padilla filed a Charge of Discrimination with the Equal Employment Opportunity Commission and the Florida Commission on Human Relations on November 3, 2023. The EEOC issued a Notice of Right to Sue against Disney Vacation Development on December 19, 2023.
