A class action lawsuit claims the labels on Rowdy energy drinks are meant to deceive consumers.
Austin Cave is the named plaintiff in the lawsuit was filed in federal court against Rowdy Beverage Inc. On behalf of himself and others similarly situated, Cave claims Rowdy's marketing practices related to the advertising, labeling and sale of its Power Burn Energy Drinks are misleading.
According to the complaint, the global energy drink market was valued at nearly $85 billion in 2021 and is predicted to more than double by 2030. With consumers increasingly seeking healthier options and "clean label" products, the complaint says companies such as Rowdy have a responsibility to accurately represent their products.
Despite Rowdy's claim of "No Preservatives" on its product labels, Cave claims the drinks contain significant amounts of citric acid and ascorbic acid. Both are classified as preservatives by the Federal Food and Drug Administration. This misrepresentation, according to the complaint, has allowed Rowdy to sell its products to hundreds of thousands of unsuspecting consumers throughout Florida and the United States at a premium price.
