Parents file ADA lawsuit against Hillsborough County schools

The parents of a Hillsborough Conty student claim the school board have violated the Americans with Disabilities Act.

The parents, identified only as J.S. and L.S., filed their lawsuit in federal court against the School Board of Hillsborough County on behalf of their minor child identified only as A.H.S. The suit alleges violations of the Individuals with Disabilities Education Act, Section 504 of the Rehabilitation Act of 1973 and Title II of the Americans with Disabilities Act.

The parents are seeking review of a final order from an Administrative Law Judge who concluded that the defendant did not violate IDEA and Section 504 in their education of A.H.S. The plaintiffs also seek redress for ADA violations which were not considered due to claimed lack of jurisdiction by the ALJ.

In addition to seeking review, the parents are looking for enforcement of a provision requiring compensatory education from the defendant, which they claim has been failed to provide for several years. They are also seeking recovery of attorney fees.
