A Florida-based company has filed a trademark infringement lawsuit against another.
One Island LLC filed its lawsuit against Kathleen McDonald Sergeant and On Island Inc. in federal court.
According to the complaint, One Island is seeking declaratory relief under the Trademark Act of 1946 and other related laws. The plaintiff alleges a certain United States Trademark Registration held by the defendants is invalid.
The complaint also says that on November 29, 2023, Sergeant sent a written demand to One Island accusing it of trademark infringement and demanding immediate cessation of activities. The dispute revolves around U.S. Trademark Registration No. 5536184 for the standard character mark ON ISLAND.
One Island says this registration appears to be invalid and abandoned and should be subject to cancellation. The plaintiff seeks a court declaration confirming it does not infringe any trademark right of the defendants.
