Former employee accuses AirGas USA of age discrimination, retaliation

A former employees says she was a victim of age discrimination and retaliation by AirGas USA.

Rita Garcia filed her complaint in federal court against AirGas USA LLC.

According to the complaint, Garcia, a Hispanic woman who is now 62 years old, began working for AirGas in July 2000. She claims that after new district manager Glenn Garcia arrived at her workplace, she she experienced discriminatory undertones and outward harassment that undermined her years of experience. This hostile work environment allegedly forced her to resign from her position as a sales representative assisting clients in the Latin American region.

The plaintiff previously filed a Charge of Discrimination with the Equal Employment Opportunity Commission (EEOC) Miami District Office and received a Determination and Notice of Rights regarding all charges of discrimination and retaliation on August 25, 2023.

She says she suffered discrimination and retaliation under the Age Discrimination in Employment Act, Title VII of the Civil Rights Act of 1964 and the Florida Civil Rights Act of 1992.

She seeks compensatory damages.
