Two companies accuse Walmart of trademark infringement

Federal Court
Walmart

Two companies have filed a federal lawsuit accusing Walmart of trademark infringement.

DS Healthcare Group and Meditago Holdings filed the federal complaint alleging trademark infringement, common law unfair competition and common law trademark infringement.

The companies claims Walmart and an unknown distributor have been selling their products which are materially different from those intended for the U.S market, thereby infringing on their trademarks. These products include haircare, skincare and cosmetic items under various trademarks owned by Meditago and commercialized by DS Healthcare Group.

The complaint also claims the defendants have been using the plaintiffs' names and trademarks to drive internet traffic to their lower-priced infringing products, thereby decreasing the size and value of the plaintiffs' legitimate marketplace.
