Former employee sues Seventh-Day Adventists academy for FLSA violations

ORLANDO — A former employee is suing the Florida Conference Association of Seventh-Day Adventists, alleging it violated the U.S. Fair Labor Standards Act.

The defendant is doing business as Orlando Junior Academy.

Jennifer French was employed from 2003 until 2023 with the defendant in various positions over the years, according to a complaint filed Nov. 15 in U.S. District Court for the Middle District of Florida.

French claims the defendant misclassified her as an exempt employee, denying her overtime pay for overtime hours worked.

French claims she was a non-exempt employee and she regularly worked overtime hours without receiving proper compensation at time and a half. She claims the defendant's actions violated FLSA provisions, causing damages to her.

The plaintiff's job duties are not those of an exempt employee, according to the suit.

"Plaintiff does not meet all elements of either the executive, administrative or professional exemptions under the FLSA," the complaint states.

French is seeking compensatory and liquidated damages, as well as payment for all overtime hours at a rate of 1.5 her regular rate of pay. She is represented by C. Ryan Morgan of Morgan & Morgan in Orlando.
