Canadian man sues Carnival for assault aboard cruise ship

MIAMI — A Canadian man is suing Carnival Corporation claiming it's responsible for injuries he sustained in an assault while he was waiting to disembark one of its cruise ships.

Jeffrey Post claims the defendant, who owns and controls the Carnival Panorama cruise ship, is liable for negligence resulting in serious long-term injuries, according to a complaint filed in U.S. District Court for the Southern District of Florida.

The incident occurred on November 19, 2022, when the plaintiff, a paying passenger, was assaulted by an assailant while standing in line to disembark. 

The plaintiff claims that the defendant had exclusive custody and control of the vessel and, therefore, bears responsibility for the incident.

The plaintiff claims that the defendant was aware of the risk of assaults and batteries on its vessels, citing a history of reported incidents between 2016 and 2022. 

Despite this knowledge, the defendant failed to take adequate security measures or provide sufficient supervision to prevent such incidents, according to the suit.

Post claims that the defendant intentionally omitted warnings about the prevalence of assaults and batteries to avoid deterring prospective passengers, asserting that this willful conduct warrants punitive damages.
