Judiciary watchdog: 'Federal judge censure in Trump criminal case isn't enough'

U.S. Rep. Matt Gaetz (R-Fla)’s investigation of U.S. District Judge Tanya Chutkan is intended to put her on defense but it’s all for show, according to the founder of two judiciary watchdog groups.

“I applaud Matt Gaetz for it, but nothing will happen in the investigation,” said Ocala Attorney Larry Klayman who founded Judicial Watch and its off-shoot Freedom Watch. “Nothing happens with any Republican investigation.”

Klayman was reacting to a resolution Gaetz introduced that would censure and condemn Chutkan if approved by a Congressional majority.

“U.S. District Court Judge Tanya Chutkan has exhibited open bias and partisanship in the conduct of her official duties as a judge for the U.S. District Court for the District of Columbia,” Gaetz's proposed Aug. 17 resolution states. “In a more recent sentencing hearing in October 2022, Chutkan lamented that Donald Trump ‘remains free to this day.’ Whereas such partisan commentary by Judge Chutkan has been ongoing and calls into question her fitness as a judge.”

Chutkan is presiding over Pres. Donald Trump’s conspiracy to challenge the 2020 election criminal case that was brought by the Department of Justice.

“I've had cases with her and she's lawless,” Klayman told the Florida Record. "She does whatever she wants regardless of the law. She resents white people. She's gone after Judge Trevor McFadden when he asked at a sentencing hearing why the Justice Department isn’t holding Black Lives Matter accountable. She is a vile person.”

McFadden was appointed to the federal judiciary in 2017 by Trump.

Klayman would rather see Congressman Jim Jordan (R-Ohio), who is chair of the House Judiciary Committee, hold Chutkan accountable because it would not require a vote.

"Jim Jordan has the power to institute proceedings to impeach Judge Chutkan but he hasn't held any judge accountable for anything and he's not a lawyer,” he said. “Congressman Jordan is a wrestling coach from Ohio State who shouldn't be head of the Judiciary Committee. My problem with him is that he's all talk and no action." 

As previously reported in the Epoch Times, Chutkan allegedly stated that Pres. Trump 'remains free to this day' during another Jan. 6-related sentencing.

"Judges won't police themselves so you have judicial councils when they commit an ethical violation but they are made up of fellow judges in the same federal courthouse," Klayman added. "My criticism towards certain federal judges, particularly in DC, doesn't extend to state judges. To a large extent, I find state judges in Florida to be fair and just, because they answer to the people. They can be voted out of office."
