Florida man sues Walmart, onion distributors after contracting salmonella

ORLANDO, Fla. (Legal Newsline) — A Florida man who suffered from salmonella poisoning from onions is claiming Walmart's and other distributors' negligence. 

Wayne Pagan filed a complaint July 20 in Orange County Circuit Court against Prosource Produce LLC, Keeler Family Farms LLC, Walmart Stores East LP, doing business as Walmart Supercenter #1220, and others alleging liability, negligence and other claims. 

According to Pagan's complaint, the Centers for Disease Control and Prevention (CDC) identified onions distributed by the defendants as the source of a salmonella outbreak in October of 2021. Pagan claims he purchased the onions from a Walmart in Orlando throughout the summer of 2021 and in August of 2021, purchased a steak and cheese sandwich containing the onions from an Orlando-area Firehouse. 

He alleges that on Aug. 27, 2021, he was admitted to the hospital and tested for salmonella bacteria which was caused from the defendants' onions. Pagan claims the defendants' negligence for importing, manufacturing and distributing the onions and failing to properly test the product before placing it in the stream of commerce. He also claims the defendants failed to prevent human and animal feces from coming into contact with the onions and did not monitor safety conditions at its facilities. 

Pagan seeks monetary relief of more than $50,000, interest, trial by jury and all other just relief. She is represented by Liz Zwibel of Gomez Trial Attorneys in St. Petersburg and Ron Simon of Ron Simon & Associates in Houston.
