Transgender worker alleges he was fired after supervisor discovered biological gender

TAMPA, Fla. (Legal Newsline) — A transgender worker alleges he suffered discrimination and was fired from a Florida company after a supervisor discovered his biological gender was female.  

Kelley Murphy filed a complaint April 30 in Hillsborough County Circuit Court against Charter Communications, Inc., alleging violation of the Florida Civil Rights Act and other claims. 

According to his complaint, Murphy identifies as male and began working for Charter in August of 2019 as a field technician in Tampa. He alleges that in the beginning of 2021, his supervisor asked for his driver's license to update employment paperwork and noticed his biological gender identification on the license. 

Murphy further alleges that after his supervisor's discovery of his biological gender, he was told it would be better to quit before he was fired and that he began to be written up for any reason, with his co-workers receiving no reprimands for the same infractions. After being terminated in June of 2021, he was issued a Notice of Right to Sue from the EEOC regarding the discrimination. 

Murphy seeks monetary relief, interest, trial by jury and all other just relief. He is represented by Jason Imler of Imler Law in Lutz.
