MIAMI (Legal Newsline) - Shutterfly Lifetouch faces a class action lawsuit over allegedly unsolicited telemarketing.

Lisa Crichlow Helly filed suit June 6 in Broward County Circuit Court under the Florida Telephone Solicitation Act. She is represented by Manuel Hiraldo of Fort Lauderdale.

The suit cites texts sent to Helly for Lifetouch Pictures offering discounts.

"Given Defendant's use of generic text messages to solicit consumers, Plaintiff is informed and believes that Defendant caused similar telephonic sales calls to be sent to at least 50 individuals located in Florida," the suit says.

It adds that Lifetouch used an automatic number dialer to generate targets who never provided consent to be texted.

The defendant removed the case to federal court on July 8.
