Consolidated Nuclear Security sued over termination of employee

AMARILLO, Texas (Legal Newsline) - Stephen “Cobey” Monden filed a federal lawsuit on Jan. 11 in U.S. District Court for the Northern District of Texas against Consolidated Nuclear Security (CNS) for violation of the National Defense Authorization Act, implicit fraud, negligence and misrepresentation. 

According to the complaint, Monden started work at the Pantex Plant when CNS learned of “overtime anomalies” related to employee timekeeping at the end of 2018. In January 2019, the company began to compare employee time records entered into a software program called OneTime with Argus badge reader records, the suit says. 

Monden and more than 50 other people were interviewed by the Inspector General's Office about potential timekeeping fraud done by CNS, the suit says. Monden was fired for alleged “fraudulent timekeeping practices” after his interview. 

Monden seeks actual damages, back and front pay, compensation for loss of employee benefits, reinstatement of his employment and position, compensatory damages for past and future pecuniary losses, emotional pain, suffering and inconvenience, exemplary or punitive damages, pre and post judgment interest, attorney's fees and cost of suit. Monden is represented by Eric J. Cassidy of Houston.
