Lawsuit: Melee over towed car included truck crashing into fence

TAMPA - A man is suing a towing company for personal injury caused after a tow truck crashed into a fence. 

Roderick Jenrette filed a lawsuit on Jan. 17 in the Hillsborough County Circuit Court against Donna Helton and Kenneth Helton d/b/a A & J Towing, Anthony Scott Charlton-Bates and John Hodges for negligence and vicarious liability.

According to the lawsuit, on March 3, 2018, Jenrette was informed by a security guard that his vehicle was being towed. Jenrette went out to find his car being attempted to be towed by Charlton-Bates, he says. 

After the two were unable to agree on a price, Charlton-Bates allegedly kicked Jenrette in the chest, pushed him back from the tow truck and physically attacked him. Hodges then arrived on the scene and began physically attacking Jenrette as well, the suit says. 

The two allegedly left the truck's gearshift in drive, causing the truck to crash into a plastic fence. Pieces of the fence then struck Jenrette and caused serious, permanent injuries, he claims.

Jenrette was caused to suffer bodily injury, the expense of hospitalization and medical and nursing care treatment, loss of earnings, resulting pain and suffering, disability or physical defect, disfigurement, mental anguish, inconvenience and the loss of capacity for the enjoyment of life.

Jenrette seeks damages, interest and cost of suit. Jenrette is represented by Courtney A. Umberger of Fulgencio Law, PLLC.
