TALLAHASSEE -- A former inmate is suing the Florida Department of Corrections for a roof collapse that allegedly resulted in permanent injuries.
Tony Lee Franchinni filed a lawsuit on Nov. 3 in Leon County Circuit Court against the Florida Department of Corrections for common law negligence and violation of the Title II of the Americans with Disabilities Act.
According to the complaint, Franchinni was an inmate at the Lake Butler Reception and Medical Center, Unit B-1 Dorm, when the building collapsed while Plaintiff was in the restroom with five other inmates. Franchinni was knocked unconscious, he says.
After months of filing multiple grievances to be seen my medical staff, it was found that he had profound hearing loss due to the collapse, the suit says. Franchinni adds he was caused to suffer severe head trauma, denied medical treatment and intervention, profound hearing loss, headaches, blurred vision and nerve pain.
