Lawsuit: Manatee County law firm missed filing deadline and cost client hundreds of thousands

Lawsuit

ORLANDO - A Manatee County law firm was brought to court after it allegedly made simple mistakes that cost a client its case.

The complaint was filed on April 19 in the Orange County Circuit Court by plaintiff Rymark Contracting. According to the complaint, Rymark needed to take a hotel to court after it was not paid in full for renovations made to the hotel and hired defendant Hamilton, Price and Marshall PA and attorney William Scott Hamilton to be its representation.

The plaintiff says the defendants missed an important claim filing deadline and that Rymark was unable to enforce its claim of lien and collect on a surety bond.

The defendants are charged with professional malpractice and breach of fiduciary duty, and Rymark seeks to recover the damages it would have won if not for the defendants' alleged incompetence plus other payback deemed appropriate.

The plaintiff is represented by the Morgan and Morgan Tampa PA Business Trial Group of Tampa.
