Fandango accused of illegally tracking consumer behaviors in new class action suit

FORT LAUDERDALE - Fandango Media faces a class action lawsuit originally filed in the Palm Beach County Circuit Court for allegedly violating the Florida Security of Communications Act (FSCA).

The class is represented by plaintiff Jason Goldstein, a Palm Beach resident who said in a Feb. 8 lawsuit that Fandango illegally used software to intercept his interaction with the Fandango website. Goldstein accuses Fandango of wrongfully tracking his mouse clicks and movements, words typed and other information inputted and pages/content viewed. 

Fandango is also accused of tracking the plaintiff's location, time and date of visit without obtaining his consent. It recently removed the case to Fort Lauderdale federal court.l

The lawsuit says that the invasive tracking procedure for financial gain is a violation of the FSCA and is requesting judgment from the court for damages. 

The plaintiff is represented by Andrew Shamis of Shamis and Gentile PA of Miami, Edelsberg Law PA of Aventura and Hiraldo PA of Fort Lauderdale.
