Apopka property owners allege insurance company failed to pay for damage

ORLANDO — Two Apopka property owners are suing a licensed insurer, alleging breach of an insurance policy.

Christopher and Jennifer Kennedy filed a complaint Feb. 11 in Orange County Circuit Court against Southern Fidelity Insurance Company, alleging the insurer has failed to pay part of the plaintiffs' claim for insurance benefits.

According to the complaint, on June 1, 2018, the Kennedy property at 3435 Players Point Loop, Apopka, was damaged by a covered cause of loss. The Kennedys say they timely reported the damage to Southern Fidelity and was assigned a claim number. 

As a result of the defendant's actions, the suit says, the Kennedys have sustained financial damages, including the cost to repair/replace damage to the dwelling. The plaintiffs allege Southern Fidelity Insurance has failed and refuses to pay for the loss and/or damage covered by the policy.

The Kennedys seek trial by jury, damages that exceed $15,000, exclusive of court costs, interest and attorney fees, plus all further just and proper relief. They are represented by attorney Michael B. Germain of Germain Law Group in Tampa.
