Consumer accuses debt collectors of illegal practices

ORLANDO — An Indiana woman is suing debt collectors, alleging illegal debt collection practices.

Martha A. Mikel filed a complaint Feb. 11 in Orange County Circuit Court against Noble Resorts Corporation and The Berkley Group Inc., alleging violation of the Florida Consumer Collection Practices Act.

According to the complaint, Mikel financed and purchased a timeshare for a condominium at The Berkeley Orlando in Kissimmee from Noble Resort. On Sept. 25, 2018, the suit says, Mikel retained counsel to seek rescission of the timeshare and end the timeshare interest and obligations. 

As a result of the defendants' actions, Mikel says, she has sustained financial damages. The plaintiff alleges Noble Resorts Corporation and The Berkley Group refused to provide any identification and have communicated directly with her for payment demands when they were aware that she was represented by an attorney.

Mikel seeks trial by jury, damages that exceed $15,000, exclusive of attorney fees and costs, and all other just and proper relief. She is represented by attorneys Robert Baldwin and Brian P. Parker of DC Capital LLP in Washington, D.C..
