Consumer accuses timeshare business of abusive debt collection practices

ORLANDO — A Pennsylvania woman is suing an Orlando timeshare business, alleging abusive debt collection practices.

Kathleen A. MacDonald of Monroeville, Pennsylvania, filed a complaint Feb. 11 in Orange County Circuit Court against Vistana Signature Experiences Inc. alleging violation of the Florida Consumer Collection Practices Act.

According to the complaint, on Oct. 17, 2017, MacDonald agreed to purchase a timeshare interest in the Sheraton Flex Vacations ownership plan. Soon after, the suit states, MacDonald hired the services of an attorney to rid her of the timeshare interest and seek rescission of the contract with Vistana. 

The plaintiff alleges Vistana Signature Experiences continued to contact her after knowing that she was being represented by legal counsel and that it unlawfully disclosed MacDonald's debt on her credit reports without providing notice that the debt is in dispute.

MacDonald seeks trial by jury, damages that exceed $15,000, exclusive of attorney fees and court costs, plus all other just and proper relief. She is represented by attorneys Robert Baldwin and Brian P. Parker of DC Capital Law LLP in Washington, D.C..
