CLEARWATER — A Pinellas County woman is suing a Largo condominium complex owner, alleging negligence and premises liability.
Diane Gallagher filed a complaint Feb. 11 in Pinellas County Circuit Court against Maidstone Condominium Association Inc., alleging failure to exercise reasonable care for the safety of its invitees.
According to the complaint, on Nov. 27, 2017, Gallagher was a business invitee on the Maidstone Condominium complex in Largo when she was injured due to a dangerous staircase that lacked handrails, had non-uniform tread depths and riser heights, and no guards. She said she sustained bodily injuries, resulting in pain and suffering, impairment, disability, inconvenience, disfigurement and the expense of hospitalization, medical and nursing care and treatment.
The plaintiff alleges Maidstone Condominium Association failed to maintain the premises in a reasonably safe condition and failed to provide adequate warning of the dangerous conditions that it knew about or should have known.
Gallagher seeks trial by jury, damages that exceed $15,000, exclusive of court costs and attorney fees. She is represented by attorney Zachary Leacox of Rubenstein Law PA in Miami.
