Orlando property owners allege insurance company failed to cover sinkhole damage

ORLANDO — Two property owners are suing a licensed insurer, alleging breach of an insurance policy regarding damage from a sinkhole.

Reynaldo Gonzalez Fajardo and Elia Librada Millian filed a complaint Jan. 30 in Orange County Circuit Court against American Security Insurance Company, alleging failure and refusal to acknowledge a covered loss.

According to the complaint, on June 16, 2017, Fajardo and Millian discovered structural damages to their insured dwelling at 2710 Camomile Drive, Orlando, as a result of sinkhole activity. The suit says the plaintiffs have made an application for insurance benefits under the American Security policy. 

The plaintiffs allege American Security Insurance has denied their claim based upon the finding of the defendant's  engineering firm that the sinkhole loss was not exhibited at the insured’s residence.

Fajardo and Millian seek trial by jury, damages in excess of $15,000, exclusive of interest, attorney fees and court costs, plus all further proper relief. They are represented by attorneys Jerry Jaramillo and John P. Sacks of Jerry Jaramillo & Associates PA in Tampa.
