Construction materials supplier alleges contractors owe $32,000

ORLANDO — A construction materials supplier is suing contractors, alleging breach of contract and breach of a guaranty agreement in failing to pay more than $32,000.

Cemex Construction filed a complaint Jan. 30 in Orange County Circuit Court against Samanda Industries and Fausto Dasilva, alleging failure to perform their contractual obligations.

According to the complaint, between October-November 2018, CEMEX supplied construction materials to the defendants on an open account agreement. As a result of the defendants' breach, the suit says, the plaintiff has suffered damages in the amount of $32,794.02. T

The plaintiff alleges Samanda Industries and Dasilva have failed to make payments when due.

CEMEX Construction seeks trial by jury, damages of $32,794.02, exclusive of fees, court costs and interest, plus all other appropriate relief. It is represented by attorney Ryan E. Davis of Winderweedle, Haines Ward & Woodman in Winter Park.
