ORLANDO — An Orange County man is suing another driver, alleging the defendant's negligence caused a rear-end collision that injured the plaintiff.
Gustavo Portalanza filed a complaint Jan. 29 in Orange County Circuit Court against Jonathan Robert Perez, alleging the motorist operated his vehicle at a dangerously high rate of speed.
According to the complaint, on Dec, 4, 2017, Portalanza was traveling along state Route 408 in Orange County, when Perez negligently rear-ended the plaintiff's vehicle as Perez merged from Interstate Highway 4 onto 408 at a high rate of speed.
Consequently, the suit says, the collision caused Portalanza to sustain bodily injuries, resulting in pain and suffering, disability, disfigurement, mental anguish, loss of capacity for the enjoyment of life, expense of hospitalization, medical and nursing care and treatment, loss of earnings, loss of the ability to earn money, and aggravation of a previous existing condition.
The plaintiff alleges Perez failed to follow at a safe distance behind Portalanza's motor vehicle, failed to slow down or take any precautionary measures, and failed to timely apply the brakes.
Portalanza seeks trial by jury, damages that exceed $15,000, together with court costs and pre-judgment interest. He is represented by attorney Fanny Nater of Orlando.
