Guest alleges Maitland property owners' negligence led to fall

ORLANDO — An Orange County woman is suing Maitland property owners, alleging failure to warn and negligence led to injuries to the plaintiff.

Wendy W. Burke filed a complaint Jan. 29 in Orange County Circuit Court against Richard Potts and Saralinda Potts, alleging they failed to exercise reasonable care to ensure the plaintiff’s safety.

According to the complaint, in February 2018, Burke was a guest and lawfully upon the Potts' premises at 989 Stonewood Lane, Maitland. While walking, the suit says, the threshold was uneven, causing Burke to lose her footing and slip and fall onto the floor. 

Burke says she sustained injuries in and about her body and extremities, resulting in pain and suffering, disfigurement, scarring, mental anguish and the expense of hospitalization, medical and nursing care and treatment. 

The plaintiff alleges Richard Potts and Saralinda Potts failed to to adequately maintain the area inside their residence and failed to adequately warn Burke of the danger of the uneven floor.

Burke seeks trial by jury, damages that exceed $15,000, exclusive of interest, court costs and attorney fees. She is represented by attorney Trenton M. Swan of Todd K. Miner, PA in Orlando.
