CLEARWATER — A motorist is suing a vehicle driver and owner, alleging their negligence caused a crash in Pinellas County that injured the plaintiff.
Virgil Havice filed a complaint Jan. 29 in Pinellas County Circuit Court against Carolina Barnett and Clifton Barnett, alleging Clinton Barnett, as vehicle owner, was vicariously liable for the actions of the driver, Carolina Barnett.
According to the complaint, on May 3, 2017, Havice was operating his 1994 Chevrolet on state Road 1275 in Pinellas County when he was involved in an automobile collision with the defendants' 2004 BMW..The suit says Havice sustained bodily injuries, resulting in pain and suffering, disability, disfigurement, mental anguish and loss of capacity for the enjoyment of life.
The plaintiff alleges Carolina Barnett negligently operated and maintained Clinton Barnett's BMW so that it collided with Havice;s Chevy.
Havice seeks trial by jury, damages in excess of $15,000, plus court costs and fees. He is represented by attorney John L. Mulvihill of Corless Barfield Trial Group LLC in Tampa.
