Parents, son accuse daycare facility operators of negligence

CLEARWATER — Pinellas County parents and their son are suing Palm Harbor daycare facility operators, alleging negligence.

Matthew Egan and Crystal Mills, individually and as parents and next friend of Jack Egan, a minor, filed a complaint Jan. 15 in Pinellas County Circuit Court against Ashlei Burke and The Learning Experience Corporation, alleging failure to protect Jack Egan against foreseeable risk of personal injury or harm.

According to the complaint, on Nov. 16, 2017, Jack Egan was under the care of the defendants when he was injured in his classroom. The suit says Egan was unable to stand and/or bear weight and was later diagnosed with a spiral fracture to his left femur. 

Matthew Egan and Crystal Mills allege they have lost their son's support, services and companionship. The plaintiffs allege Burke and The Learning Experience breached their duty of care to supervise Jack Egan, to ensure he did not meet with foreseeable injury.

Egan and Mills seek trial by jury, damages in excess of $15,000, exclusive of interest, and court costs. They are represented by attorneys David J. Carter and Michael Keenan of Mickey Keenan PA in Tampa.
