Former resident accuses Clearwater nursing home operators of infringement of rights

CLEARWATER — A former resident is suing Clearwater nursing home operators, alleging negligence.

Cheryl Conkel filed a complaint Jan. 15 in Pinellas County Circuit Court against Hearthstone Senior Communities Inc., Clearwater Center and administrator Roy Daniel Newland, alleging failure to provide adequate and appropriate evaluation and care.

According to the complaint, between Dec. 26, 2013-Nov. 20, 2017, Conkel was a resident at the defendants' Clearwater nursing home facility. As a result of their negligent acts and omissions, the suit says, Conkel was caused to fall and sustain bodily injuries, resulting in pain and suffering, disability, disfigurement, mental anguish, and loss of capacity for the enjoyment of life. 

The plaintiff alleges the defendants failed to monitor and provide a safe environment, failed provide the proper custodial, medical, and nursing care and failed to properly notify Conkel's physician of significant health changes in her condition.

Conkel seeks trial by jury, damages in excess of $15,000, exclusive of costs and court fees. She is represented by attorneys Kevin Sparkman and Chris Limberopuolos of The Florida Law Group in Tampa.
