Customer alleges Publix negligence led to eye injury

ORLANDO — An Orange County woman is suing Publix Supermarkets and others, alleging negligence resulted in the plaintiff suffering an eye injury.

Ewa Bushee filed a complaint Jan. 23 in Orange County Circuit Court against Publix Supermarkets Inc., Sewell Products of Florida LLC and Spar Business Services Inc., alleging failure to adequately maintain the premises.

According to the complaint, on March 6, 2015, while Bushee was lawfully at the Publix grocery store No. 542, 2600 Maguire Road, Ocoee, a bottle of Clorox Pool & Shock Xtra Blue was improperly stocked/sealed/secured. The suit says this caused the bottle to fall and pop open, with the substance in the botte getting into Bushee's eye. 

As a result, Bushee says she sustained bodily injuries, resulting in pain and suffering, disability, disfigurement, permanent and significant scarring, mental anguish, loss of the capacity for the enjoyment of life, medical expenses, loss of earning, and aggravation of an existing condition. 

The plaintiff alleges the defendants failed to properly maintain and inspect products on display, failed to adequately warn Bushee of the dangerous product, failed to adequately train its employees to inspect, maintain and correct any dangerous condition on its premises and failed to render aid to the plaintiff after her injuries.

Bushee seeks trial by jury, and damages in excess of $15,000. She is represented by attorney Nicholas P. Panagakis of Morgan & Morgan PA in Orlando.
