CLEARWATER — A Pinellas Park couple is suing an insurance company, alleging breach of contract.

Bill House and Diana House filed a complaint Jan. 14 in Pinellas County Circuit Court against Citizens Property Insurance Corporation, alleging failure to provide coverage for the plaintiffs' losses.

According to the complaint, between the policy period of May 14, 2018-May 14, 2019, the Houses' dwelling at 5550 102nd Ave., Pinellas Park, sustained a covered loss due to water damages. The Houses say they notified Citizens Property of the damages and received an assigned claim number.

However, the suit says, despite complying with all conditions precedent to entitle them to recover under the policy, Citizens Property has waived its compliance in providing insurance coverage.

The plaintiffs allege Citizens Property Insurance has failed to pay for all losses.

The Houses seek trial by jury, any overdue payments, consequential damages of more than $15,000, plus attorney fees and court costs. They are represented by attorney Morgan Vasigh of Morgan & Morgan PA in Tampa.
